A contract is a legally enforceable agreement that ensures all parties are bound by mutually accepted terms. It typically includes key elements such as offer, acceptance, consideration, and intention to create legal relations. When properly drafted, contracts help prevent misunderstandings, reduce risks, and provide legal remedies in case of disputes. What is a Will in the GCC
In the GCC, a Will allows a person—particularly non-Muslim expatriates, where permitted under the applicable GCC jurisdiction, with a legal mechanism to determine how their estate is to be distributed and administered. Under applicable GCC laws, non-Muslim foreign residents may, subject to the relevant legal requirements, adhere to the law of their home country in relation to inheritance and Wills.
A Will is a legally recognized document through which an individual (the testator) sets out how their assets, property, and personal matters are to be handled and distributed after their death.
Key Features of a Will in GCC Jurisdictions
- Legal Declaration: It expresses the testator’s intentions regarding the distribution of assets and appointment of guardians, where applicable.
- Asset Distribution: Covers movable and immovable assets, subject to the laws and jurisdiction applicable to those assets.
- Guardianship Provisions: Allows appointment of guardians for minor children.
- Registration Requirement: For enforceability and smooth execution, Wills are typically registered with recognized authorities such as:
- DIFC Courts Wills Service Centre
- Abu Dhabi Judicial Department
- Dubai Courts
